Terms of sale

Article 1 — Purpose

These Terms of Sale govern the contractual relationship between ZooCroc (SIRET: 990 758 062 00014), whose registered office is at 43 rue Jean Jaurès, 18500 Foëcy, France, and any customer making a purchase on the zoocroc.shop website.

Article 2 — Orders

Placing an order on the site constitutes acceptance of these Terms of Sale. ZooCroc reserves the right to cancel any order in the event of insufficient stock or suspected fraud. A confirmation e-mail is sent as soon as the order is validated.

Article 3 — Prices

Prices are shown in euros inclusive of all taxes and exclude shipping costs. ZooCroc operates under the French small-business VAT exemption scheme: VAT not applicable, Article 293 B of the French General Tax Code. No VAT is therefore charged and the price shown on the product page is the final price. Any applicable shipping costs are shown before the order is validated and included in the total payable displayed at checkout: the customer thus knows the full amount due, shipping included, before confirming the order. ZooCroc reserves the right to change its prices at any time; orders are invoiced at the price in force when they are validated.

Article 4 — Payment

Payment is due when the order is placed. Transactions are secured through Shopify Payments. ZooCroc stores no bank card data.

Article 5 — Delivery

Orders are prepared and dispatched within 1 to 2 working days of payment. Delivery then takes 10 to 12 working days in mainland France and 6 to 14 working days within the European Union. Outside the European Union, allow 10 to 20 working days. Standard delivery is free in mainland France, with no minimum purchase; Express is €1.99 (free from €45). Shipping costs are €9.99 within the European Union (free from €80). ZooCroc also delivers to 14 countries outside the European Union at a flat rate of €29, with no free-shipping threshold; those shipments may incur customs duties and import taxes set by the destination country and payable by the customer. Article 6 — Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has 14 days from receipt of the order to exercise the right of withdrawal, without giving reasons and without penalty. Withdrawal is exercised by written notice sent to zoocroc.shop@gmail.com or using the model withdrawal form reproduced in our return policy. Products must be returned within 14 days of that notice, complete and in their original condition; return shipping costs are borne by the customer. The refund, including the standard delivery charges initially paid, is issued no later than 14 days after receipt of the return, using the same payment method as the original order. In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to sealed products unsealed after delivery which cannot be returned for hygiene or health-protection reasons, nor to personalised products. Article 7 — Statutory guarantees

Irrespective of any commercial warranty, ZooCroc remains liable for lack of conformity and for hidden defects.

Statutory guarantee of conformity — Articles L217-3 to L217-14 of the French Consumer Code: the customer has 2 years from delivery of the product to act. The customer may obtain repair or replacement of the item and, if those remedies are impossible or cannot be provided within one month, a price reduction or cancellation of the sale with a refund. Enforcing this guarantee is entirely free of charge for the customer.

Guarantee against hidden defects — Articles 1641 to 1649 of the French Civil Code: if the product has a hidden defect making it unfit for its intended use, the customer may choose between cancellation of the sale and a price reduction, within 2 years of discovering the defect.

To enforce either guarantee, simply write to zoocroc.shop@gmail.com describing the problem and attaching photographs where possible. ZooCroc replies within 48 working hours and bears the return shipping costs where the lack of conformity is established.

Article 8 — Disputes

In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the French courts shall have jurisdiction. You may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr

Article 10 — Personal data

Personal data collected when an order is placed is processed by ZooCroc, as data controller, for the purposes of order management, delivery, invoicing and after-sales service, on the basis of performance of the contract. The customer has the right to access, rectify, erase, restrict, object to and port their data, as well as the right to lodge a complaint with the French data protection authority (CNIL).
