Terms of service
Welcome to ZooCroc. The terms "we", "our" and "us" refer to ZooCroc, which operates this online store together with all associated information, content, features and services (the "Services"). The store is powered by the Shopify platform. These Terms of service, along with the policies they refer to, set out your rights and obligations when you use the Services. By visiting this site or placing an order, you accept these terms. If you do not accept them, please do not use the Services.
Article 1 — Capacity
You confirm that you are at least 18 years old, or have the authorisation of your legal guardian, and that you have the legal capacity to enter into a contract.
Article 2 — Site access and customer account
Creating an account is not required in order to place an order. If you do create one, you are responsible for keeping your credentials confidential and for any activity carried out from your account. Notify us immediately at zoocroc.shop@gmail.com if you suspect unauthorised use. We may suspend or close an account in the event of a breach of these terms or of fraudulent activity.
Article 3 — Our products
We make every effort to describe and photograph our products accurately. Perceived colours and dimensions may nevertheless vary depending on your screen, and manufacturers' packaging sometimes changes. The products sold are accessories, food and supplements for pets: they are not medicines and they are no substitute for veterinary advice. Available quantities may be limited and we may change or withdraw a product at any time.
Article 4 — Orders
Any order placed on the site constitutes an offer to buy. The contract is formed when we send you the shipping confirmation e-mail. We may refuse or cancel an order, in particular in the event of an obvious pricing error, unavailable stock or suspected fraud; in that case you are refunded in full. The detailed sales conditions are set out in our terms of sale.
Article 5 — Prices and billing
Prices are shown in euros inclusive of all taxes. ZooCroc operates under the French small-business VAT exemption scheme: VAT not applicable, Article 293 B of the French General Tax Code. Shipping costs are shown before the order is validated and included in the total displayed at checkout. You undertake to provide accurate and up-to-date payment information, and you confirm that you are authorised to use the payment method employed. Where a promotion applies, the terms specific to that offer prevail over these terms.
Article 6 — Delivery, withdrawal and guarantees
Shipping times and costs are detailed in our shipping policy. Your 14-day right of withdrawal, our 30-day commercial gesture and the statutory guarantees of conformity and against hidden defects are detailed in our return and refund policy.
Article 7 — Reviews and user-generated content
If you post a review, comment or photo, you warrant that you hold the rights to it and you grant us a free, non-exclusive licence to display it on the site and in our communications. We may refuse or remove any content that is unlawful, defamatory, misleading or off-topic. Your reviews are not subject to any consideration and we do not alter their content.
Article 8 — Prohibited uses
You undertake not to use the Services for unlawful purposes, not to attempt unauthorised access to our systems, not to automatically harvest data from the site, not to introduce malicious code, not to impersonate a third party and not to disrupt the operation of the site or the security of other users.
Article 9 — Intellectual property
The texts, images, logos and graphic elements of the site are protected and remain the property of ZooCroc or its partners. No reproduction or exploitation, in whole or in part, is permitted without our prior written consent.
Article 10 — Third-party links and services
The site may contain links to third-party sites and relies on third-party providers (hosting, payment, shipping). We do not control their content or practices and accept no liability in that respect. Their use is governed by their own terms.
Article 11 — Availability and liability
We strive to keep the site available without being able to guarantee continuous availability: interruptions for maintenance, technical incidents or external causes are possible. We cannot be held liable for indirect damage, nor beyond the amount of the order concerned. None of these limitations affects the rights that French law mandatorily grants to consumers, in particular the statutory guarantees.
Article 12 — Force majeure
We cannot be held liable for any delay or failure to perform resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code, such as a natural disaster, industrial action affecting carriers, a general network outage or an administrative decision.
Article 13 — Personal data
The processing of your data is described in our privacy policy and in our legal notice, which specify the data controller, the purposes, the legal bases, the retention periods and your rights.
Article 14 — Changes to these terms
We may change these terms at any time. The version applicable to your order is the one online at the moment you place it. We encourage you to review them regularly.
Article 15 — Governing law and disputes
These terms are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority; failing that, the French courts shall have jurisdiction. You may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr
